What is Ordinance
2287?
In an effort to protect workers from the known health dangers of second-hand smoke and to reduce
tobacco-related illness and death, almost all workplaces in Lake Oswego,
including restaurants, are required to be smoke-free.In addition, all tobacco product sales must be vendor assisted.
Self-service displays will not be allowed.
When did the ordinance take
effect?
February 22, 2001
Are there any exceptions to the
ordinance?
Yes.A few workplaces are exempt from the smoke-free workplace ordinance.They include:

bars/taverns
-
designated smoking hotel
and motel rooms
-
tobacco retail stores; and
-
private residences, unless
the residence is used as an in-home child care, adult day care, or health care
facility
Additionally, a business may
have a designated smoking break room if the following conditions are met:

the break room is not
accessible to minors
-
the break room is
ventilated to the outside and air is not re-circulated throughout the business
(ventilation standards outlined in Resolution 01-05)
-
no employee is required to
enter the break room to conduct or complete his or her work
-
sufficient non-smoking break rooms are
available to non-smokers
How will the ordinance be enforced?
Penalties will be imposed on
a complaints based system. Violations may
be reported by calling (503) 635-0238.
What are the penalties for not complying
with the ordinance?
The following penalties apply to violation of the
workplace smoking restrictions:

For a first violation, the violator is provided
with a warning and educational materials.
-
For a second violation
within a 12-month period, as an alternative to a $50 fine, a violating
employer is required to work with staff and the Clackamas County Tobacco
Education Program to develop a smoke-free workplace remediation plan. If the violator is an individual smoker, service and referral
information is provided.

For a third violation
within a 12-month period, a fine of $100
-
For a fourth violation
within a 12-month period, a fine of $250
-
For a fifth violation
within a 12-month period, a fine of $500
Violation of the new sales
regulations would result in the following fines:
-
For a first violation, a
fine of $200

For a second violation
within any two-year period, a fine of $350

For a third or greater
violation within any two-year period, a fine of $500
