A request by the City of Lake Oswego for legislative amendments to the Community Development Code (CDC) to update various sections of the CDC in order to eliminate text ambiguity, clarify text so that it reflects existing code interpretations, and to add new provisions that address:
• Building colors
• Awnings
• Sidewalk displays
• Limits on cumulative retail uses in the MC, CR&D, and IP zones and the IP overlay district.
Explanation of Proposal:
Building Colors: The proposed amendment provides three options for review of building colors: (1) exempt all new paint from Design Review; (2) create a streamlined Design Review process for color; (3) create a color palette of approved colors.
Awnings in the EC Zone: The proposed amendment makes awnings optional on single-story buildings in the EC zone that are subject to Design Review.
Sidewalk Displays in the NC, GC, EC and FMU Zones: The proposed amendment creates a program and criteria for allowing displays in the sidewalk area abutting a retail business.
Limits on cumulative retail in the MC and CR&D: The proposed amendments will bring the City into compliance with Title 4 of Metro’s Urban Grown Management Functional Plan. The MC and CR&D zones are located within an Employment District on Metro’s Title 4 map.
In the MC Zone, the following uses would not be allowed to exceed 60,000 cumulative sq. ft. of floor area on one lot or building, or on adjacent lots or parcels:
• Retail Sales
• Food and Beverage Services
• Commercial Services (salons, tailors and laundries)
In the CR&D, the following uses would not be allowed to exceed 20,000 sq. ft. or 20% of the total building floor area on a lot, whichever is less:
• Retail Sales
• Food and Beverage Services
• Commercial Services (salons, tailors and laundries)

The Findings, Conclusions & Order were approved by the Planning Commission on February 25, 2013.
The City Council has a study session on this proposal tentatively scheduled for March 19, 2013, and the public hearing tentatively scheduled for April 2, 2013. Links to the City Council meeting pages for these dates are also provided above.

At its February 11, 2013, meeting, the Planning Commission made a preliminary decision to recommend that City Council approve this proposal. The Findings, Conclusions & Order (the final decision) will be considered at the February 25, 2013, meeting.
