IV. PUBLIC HEARING
LU 05-0080, a request by Persimmon Construction, LLC. for approval of the following:
1. A 5-lot residential Planned Development.
2. A Development Review Permit to construct five townhouses.
3. A property line adjustment between Tax Lots 8900 and 8800.
4. A 14% exception to the lot coverage standard in order to increase it from an average of 40%,
to 54% (over the proposed five lots), through the Residential Infill Design Review standards.
5. Removal of eight trees to accommodate the development.
Location of Property: 690 1st Street; Tax Lot 8900 of Tax Map 21E 03 DA.The staff
coordinator is Debra Andreades, Associate Planner.
This hearing has been continued from the March 20, 2006, public hearing for the limited purpose
of permitting Commissioners Stadnik and Meisburger to ask questions of the applicant and other
interested persons who have already testified, following their review of the tape recording and
exhibits of the March 6, 2006, public hearing on this application. Responses to such questions,
and rebuttal, if any to such responses, shall be limited to the scope of the question presented. It is
anticipated that the public hearing will then be closed and the Commission will proceed towards
deliberation and decision.

Note: LU 05-0084 was scheduled to be heard tonight, but has been continued to April 17,
2006, at the request of the applicant. New public testimony on all applicable criteria will be
permitted at the April 17, Development Review Commission public hearing.
LU 05-0084, a request by Mary Jo Avery and Avamere Lake Oswego Investors, LLC for
approval of the following:
• A Development Review Permit to construct a 7,851 square-foot, 3-story office building.
• A major modification of an Approved Development Permit (LU 00-0071/LU03-0009) to
modify the Resource Conservation Protection Area (RCPA) boundary on Tax Lot 5000, in
order to provide access to the project site from Tax Lot 5000.
• Establishment of an RCPA on Tax Lot 5500.
• Removal of two trees to accommodate the development.
Location of Property: 4580 Kruse Way; Tax Lots 5000 and 5500 of Tax Map 21E 08 BB. The staff
