CALL TO ORDER City of Lake Oswego Development Review Commission Minutes November 3, 2008 Chair Bill Tierney called the Development Review Commission meeting of November 3, 2008, to order at approximately 7:00 p.m. in the Council Chambers of City Hall at 380 "A" Avenue, Lake Oswego, Oregon. II. ROLL CALL Commissioners present: Chair Bill Tierney, Gregg B. Creighton, Alby Heredia, Frank Rossi and Krytsyna Stadnik. Bob Needham and Don Richards were not present. Staff present: Hamid Pishvaie, Assistant Planning Director; Debra Andreades, Senior Planner; Evan Boone, Deputy City Attorney; and Janice Reynolds, Administrative Support. III. MINUTES (None) IV. APPROVAL OF FINDINGS, CONCLUSIONS AND ORDER LU 08-0026, a request by Piedmont Progetto Ms. Stadnik moved to approve LU 08-0026-1686, Findings, Conclusions and Order. Mr. Heredia seconded the motion and it passed 5:0. LU 07-0084, a request by Tyrone & Jackie Cruze Family Trust, LLP Ms. Stadnik moved to approve LU 07-0084-1687. Mr. Heredia seconded the motion and it passed 5:0. 01�11 : Chair Tierney each reported making a site visit. Each of the Commissioners present declared their business or occupation as follows: Creighton (architect); Heredia (real estate broker); Rossi (architectural drafter and designer); Stadnik (civil engineer) and Chair Tierney (employed by PGE). No one present challenged any Commissioner's right to hear the application. Staff Report Debra Andreades, Senior Planner, presented the staff report (dated. October 24, 2008). She showed an aerial photograph and described uses in the vicinity, including a public school. She said the applicant requested modification of an existing Conditional Use Permit that allowed the school use in a converted residence. She wanted to add four more students. Ms. Andreades reported the site met the state mandated size of outdoor play area and would continue to meet requirements regarding fencing, walkways and safe driveway access had been found to be met in the previous conditional use approval. She advised the proposal met the primary criteria that the site was physically capable of accommodating the proposed use and that the functional characteristics of the proposed use were compatible. She explained parking was based on the square footage of the building, not the number of students. She reported the Engineering Division had found that adding four students would have a negligible affect on traffic volume based on a 2006 study done for the neighborhood association that showed there was insufficient volume there to warrant traffic calming they had requested. She recommended approval of the application subject to the conditions of approval recommended by staff, which included a condition that required the applicant to apply for a building permit for a change of occupancy from a single-family residence to a school. Applicant John Shonkwiler, 13425 SW 72nd Ave., Til4ard, Oregon, 97223, represented the applicant. He said the applicant wanted to add four students and would install a "No Parking" sign on one side of the parking lot and install bicycle parking. He reported an arborist had confirmed that the graveled parking lot did help maintain the health of a tree there. He said the applicant was not really adding traffic to what had been approved before, because some of the Montessori School students were already in the public school system and at least one student each year lived close enough that his parent could walk him to school. He submitted material showing the design of bicycle parking. (Exhibit E- 6). He questioned why the City Engineer was requiring the applicant to pay additional Systems Development Charges (SDCs) for traffic improvements when the applicant was not adding any traffic. Mr. Boone advised that issue was not within the purview of the DRC. During the questioning period, Mr. Shonkwiler clarified an arborist had revised the site plan to show two trees after the applicant had submitted the plan. There was no other testimony. Chair Tierney closed the public hearing. Ms. Stadnik moved to approve LU 08-0063. Mr. Creighton seconded the motion and it passed 5:0. Chair Tierney announced final vote would be held on November 17, 2008. VI. GENERAL PLANNING & OTHER BUSINESS (None) VII.
