Present were Mayor MacLean, Councilmen Cook, Dent, Goodall, Needham and Smith, City Manager Deane Seeger, City Attorney Jim Cox, and staff members. ,Councilman Knowles was excused due to illness. Mayor MacLean offered the invocation. Minutes of the June 15th regular Council meeting were approved as mailed. PUBLIC HEARINGS 1) Public hearing on pror—,'sed formation of LID 134 (Palisades Heights No. 5 - Streets, Lighting, Sirs and Water Improvements. ) There were no oral or written remonstrances. Public hearing was closed. Resolution to form L.I.D. 134 and authorize bid call. Moved by Councilman Cook; seconded by Councilman Smith that the resolution be adopted. Motion passed unanimously. REPORTS OF COMMITTEES 1) Report of Council Committee of The Whole re: a) Park acquisition negotiations. , • b) Jaycees' beer concession for Water Ski Festival. . Moved by Councilman Dent; seconded by Councilman Needham that the report be accepted. Motion passed unanimously. REPORTS OF BOARDS AND COMMISSIONS _ 1) Report of Planning Commission on request for time extension - construction of apartments at Grimm's Corner. Moved by Councilman Cook; seconded by Councilman Needham that the extension of time be granted. Motion passed unanimously. REPORTS OF OFFICERS 1) Schedules and award of bid on W.O. 1902 (Mountain Park Phase V-A-2:'Water) and W.O. 1903 (Fir Ridge Road Water. ) Moved by Councilman Smith; seconded by Councilman Goodall that the award of contract be made to Riverside Construction, Inc. whose bid. of $71,792.50 1 ® was low. Motion passed unanimously, I 2) Report of City Manager regarding proposed City Hall relocation. After discussion, it was moved by Councilman Dent; seconded'by Councilman Cook that the lease prepared by owner of the Director's Furniture building, and as described in the City Manager's report dated July 6th, be approved. Motion passed unanimously. ORDINANCES 1) ORDINANCE NO. 1431 - AN ORDINANCE RELATING TO THE COLLECTION OF SOLID WASTE; AMENDING LOC 20.710 TO 20.740, AND DECLARING AN EMERGENCY, having been pre- posted, was read for the first time by title only. Moved by Councilman Smith; seconded by Councilman Needham that the ordinance be read the second tim^. by title only. Mr. Cook, as chairman of the Council committee to study solid waste disposal, answered Council's questions regarding this ordinance. Council voted unanimously in favor of second reading by title only. Ordinance No. 1431 was read for the second time by title only and, upon roll call vote, was unanimously adopted. 2) ORDINANCE NO. 1436 - AN ORDINANCE GRANTING A FRANCHISE TO ROSSMAN'S SANITARY SERVICE, INC. FOR THE COLLECTION OF SOLID WASTE; SETTING FORTH THE PERIOD OF THE FRANCHISE, THE RATES TO BE CHARGED, AND THE OTHER TERMS AND CONDITIONS THEREOF; REPEALING ORDINANCE NO. 560, AS AMENDED, AND DECLARING AN EMERGENCY, having been preposted, was read for the first time by title only. Moved by Councilman Dent; seconded by Councilman Cook that the ordinance be ' read the second time by title only. • Detailed discussion followed, with the City Manager, City Attorney, and Mr. Rossman answering questions and clarifying language. Motion passed unanimously. Ordinance No. 1436 was read for the second time by title only and, upon roll call vote, was unanimously adopted. 3) ORDINANCE NO. 1437 - AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF GOLF COURSE RATES AND REGULATIONS AND DECLARING AN,EMERGENCY, having been pre- posted, was read for the first time by title only. Moved by Councilman Dent; seconded by Councilman Smith ;hat the ordinance be read the second time by title only. In reply to Councilman Goodall's question, Mr. Cox explained why an ordi- nance of this nature is necessary. Motion passed unanimously. Ordinance No. 1437 was read for the second time by title only and, upon roll call vote, was unanimously adopted. • -, • RESOLUTIONS 1) RESOLUTION establishing uniform rules of play governing uselof facilities of the municipal golf course and driving range. Moved by Councilman Cook; seconded by Councilman Smith that the resolution be adopted. Motion passed unanimously. 2) RESOLUTION authorizing Finance Officer and Recorder to execute general obli- gation warrants against Sewer Fund in an amount not to exceed $122,'000. Moved by Councilman Cook; seconded by Councilman Needham that the resolution be adopted. Mr. Seeger explained the circumstances surrounding this action. Pending 11 litigation on L.I.D. 119 (Springbrook Sewer) made it impossible to include that L.I.D. in the currant improvement bond sale in the amount of $122,000. Motion to adopt resolution passed unanimously. PETITIONS AND COMMUNICATIONS 1) Communication from Lake Oswego Jaycees requesting waiver of business license II for operation of amusement rides at the Water Festival July 16, 17 and 18. Moved by Councilman Needham; seconded by Councilman Dent that the request be 11 ® granted. Motion passed unanimously. ORAL COMMUNICATIONS FROM THE AUDIENCE 1) Genevieve Browning of 192 Second Street described a traffic hazard caused by three parking spaces along S.P. right-of-way just east of State Street. She circulated copies of a petition and a map of area. II Mrs. Browning was assured that the matter will be investigated without delay. NEW BUSINESS II 1) Councilman Cook spoke briefly about the Plan Review ordinance which will be '' on Committee of The Whole agenda for July 13th. He urged the Council to talk with Planning Commission members and members of the community, as he • 11 has done, in an effort to be fully informed in this matter. Mr. Cook also suggested further study of the P.U.D. ordinance presently in force, and in- corporated into the City Code. Mayor MacLean asked that Council be prepared to di4cuss any abuses to the P.U.D. ordinance which are known to them. 2) Councilman Goodall inquired about progress. on mending the net at the driving range of the golf course.
