Approved Minutes - 1971-09-07 • .I September 7; 1971 The regular meeting cf the Council of the City of Lake Oswego convened at 7:30 p.rn. - ® Present were Mayor MacLean, Councilmen Cook, Dent, Gooda1l,. Needham and Smith, , II City Manager Deane Seeger, and staff members. Councilman Knowles is recuperating from an illness. Minutes of the August 16th regular meeting and the August 26th .special meeting 11 wore approved as mailed. : ,-,7 SPECIAL ORDER OF BUSINESS 11 1) Mayor MacLean presented certificates to Richard E. King, Chief Plant Operator, and to Van L. Byrrus, Plant Operator III. Both qualified, on a voluntary basis, for the grade of P..•Wication Plant Operator II. PUBLIC HEARINGS 1) Public hearing on proposed formation of L.I.D. 136 (Leonard-Durham Street Im- provement.) • There were no written remonstrances. The Mayor called for oral remonstrances from the audience. ® Velma Chaney, owner of 200 Leonard Street, presented a petition signed by . several property owners in the proposed district. Mrs. Chaney asked several , questions about the improvement, stating that she represented the signers of . the petition. • Mrs. Edna Farmer spoke in opposition, claiming a hardship for her mother, Mrs. taint. Mr. and Mrs. Ray Pendleton opposed formation, as did Frank Weibel, speaking as a member of the I.O.O.F. Lodge. . The public hearing was closed. Remonstrance was registered•at 22.1 percent. .Resolution forming L.I.D. 136 and confirming bid call was read. Moved by Councilman Needham; seconded by Councilman Dent that the resolution . be adopted. • Councilman Goodall asked the percentage of remonstrance including those which are not by law acceptable. The answer, 55.3 percent, including petition signers. . In reply to Councilman Cook's question, Mr. Abraham explained that the im- provement now contemplated is.. to provide proper drainage and that the Peg Tree construction is not responsible for the grade differential. Councilman Cook ' ® questioned that the community as a whole is being served. • III Councilman Needham spoke in favor of formation of the distr: ct, as did Councilman Smith who had originally opposed it. • Vote was called on the motion, and the resolution forming d:.strict was adopted,_ with Councilman Cook voting "no". , • Schedule and award of bid on L.I.D. 136 (Leonard-Durham Street Improvement).. Bids were opened at 10 a.m. , September 7th and recorded as follows: Oregon Asphalt $22,146.30 Riverside Construction 23,972.50 Portland Road & Driveway 25,746:25 Moved by Councilman Dent; seconded by Councilman Needham that the bid. be awarded to Oregon Asphalt. Motion passed unanimously. • • • 2) Public hearing on props..,. J amendment to the zoning ordinance (multi-family use in C.C. zones,) originally a part of proposed Ordinance No. 1435. There were no oral or written remonstrances. Public hearing closed. ORDINANCE NO. 1438 - AN ORDINANCE AMENDING THE ZONING ORDINANCE.OF THE CITY OF LAKE OSWEGO, AS CODIFIED IN LOC 52.120, TO PERMIT MULTI-FAMILY DWELLINGS , IN CENTRAL COMMERCIAL ZONES, AND DECLARING AN EMERGENCY - having been pre- ® posted, was read for the"first time by title only. Moved by Councilman Cook; seconded by Councilman Smith that the ordinance be read the second time by title only. Following discussion, the motion passed unanimously. Ordinance No. 1438 was read for the second time by title only • and, upon roll call vote, was unanimously adopted. • 3) Public hearing on proposed amendment to the zoning ordinance (definition of "family"), originally a part of proposed Ordinance No. 1435. There were no oral or•'written remonstrances. Public hearing closed. ORDINANCE NO. 1439 - AN ORDINANCE AMENDING THE ZONING ORDINANCE. OF THE CITY OF LAKE OSWEGO BY AMENDING THE DEFINITION OF "FAMILY" IN LOC 50.020 (12) , AND DECLARING AN EMERGENCY - having been preposted, was read for the first • time by title only. • • Moved by Councilman Needham; seconded by Councilman Cook that the ordinance • be read the second time by title only. Motion passed unanimously. Ordinance No. 1439 was read for the second time by title only and, upon roll call vote, . was unanimously adopted. • • 4) Public hearing on proposed amendment to the zoning ordinance to add provisions relating to_ duplex residential zones. (originally included in proposed ® Ordinance No. 1435.) There were no cral or written remonstrances. Public hearing closed. • ORDINANCE NO. 1440 - AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LAKE OSWEGO BY ADDING PROVISIONS RELATING TO DUPLEX RESIIIENTIAL ZONES, AND DECLARING AN EMERGENCY - having been preposted, was real for the first time by title only. • Moved by Councilman Cook; seconded by Councilman Needham that the ordinance be read the second time by title only. • Councilman Smith expressed concern that this ordinance constitutes architec- tural control which should not be imposed upon isolated zones. I1r.: Seeger., pointed out that the requirements sot forth in this ordinance are no differ- ent than those now in force in the multi-residential and industrial zones. Councilman Cook was concerned that at soma future time this ordinance might • be used arbitrarily. Ho asked the necessity of passing it at this time. .., It is proposed now so that the moratorium on duplex construction might be lifted without causing ? ;' problems. Mr. Seeger reminded Council that in case of possible abuse of the ordinance, the right of appeal from Planning Commission action would still give Council final action in the matter. • • Motion to read the ordinance for the second time passed with Councilman Smith ' voting "no." Ordinance No. 1440 was read for the second time by title only and, upon roll call vote, was adopted, with Councilmen Cook and Smith voting "no." • • 411 REPORTS OF OFFICERS 1) Six easements and one quitclaim deed presented for recording in connection with L.I.D. 134 (Palisades Heights No. 5.) Moved by Councilman Smith; seconded by Councilman Goodall that the documents be approved for recording. Motion passed unanimously. 2) The,City Manager reported on progress of City Hall relocation plans. It is anticipated that the moving will begin by October 1. • RESOLUTIONS • 1) Resolution repealing moratorium on building in duplex zones". Moved by Councilman Dent; seconded by Councilman Needham that the resolution • be adopted. Motion passed unanimously. UNFINISHED BUSINESS 1) Councilman Goodall asked if any progress has been made on creation of bike paths. City Manager reported that staff is presently involved in discussions on the matter. It is hoped that a report will .be ready within thirty days.' ' 411 NEW BUSINESS 1) Mr. Seeger reviewed the Burnett annexation proposal and requested Council' II i • 0 endorsement. The petition will be considered by the Boundary Commission at their meeting of September Bth.
