Development Review Commission Minutes
July 1, 2002
Chair Ostly called the Development Review Commission meeting of July 1, 2002 to
order at 7:03 p.m. in the Council Chambers of City Hall at 380 "A" Avenue, Lake
Oswego, Oregon.
II. ROLL CALL
Commissioners present included Ostly, Tierney, Powers, Stadnik and Fagelman.
Commissioners Binkley and Morales were excused. Commissioner Stadnik arrived at
7:07 p.m.
Staff present included Hamid Pishvaie, Development Review Manager.
III. FINDINGS, CONCLUSIONS & ORDER
Commissioner Tierney moved for approval of LU 00-0088, Findings, Conclusions
and Order. Commissioner Powers seconded the motion and it passed with
Commissioners Ostly, Tierney and Powers voting yes. Commissioner Fagelman
abstained. Commissioners Binkley, Stadnik, and Morales were not present. There were
no votes against.
III. PUBLIC HEARING
LU 01-0047, a request by Renaissance Development for approval of the following:
1. A property line adjustment of three existing lots on a 1.78 -acre parcel.
2. Delineation of the resource boundaries for the Resource Protection (RP)
and Resource Conservation (RC) Districts on the site.
3. A determination of the RC Protection Area on the site.
4. Removal of 17 trees to construct the roadway and the single-family
dwellings.
The property is located at 15393 Diamond Head Road, Tax Lots 500, 600 and 700 of
Tax Map 21E09 AC. Staff coordinator is Paul Espe, Associate Planner. This hearing is
continued from May 6, 2002.

Hamid Pishvaie, Development Review Manager reported that the applicant for this
project was requesting continuance to August 5, 2002 in order to enable him to submit
additional information identified as missing in the original staff report.
Roger Handlin, who lives right next door to the affected property came forward to
object to rescheduling the public hearing for this matter. He feels that since this public
hearing has been rescheduled so many times, no meaningful notice has been sent. Mr.
Handlin commented that, since the purpose of the recently adopted regulations,
regarding property owner notification is to promote greater public participation; he
would like the City to re -notice the affected property owners according to the new code,
which took, affect on April 4, 2002.
Hamid Pishvaie gave a brief history of the reasons for rescheduling of this matter. He
pointed out the applicant is within his rights to ask for an extension of the 120 day rule
for completion.
Discussion followed between staff and the Commission regarding whether the property
owners should be re -noticed under the new rules because the applicant could object and
claim he has met all noticing requirements. They feel that although it is not technically
or legally required, it would be appropriate to re -notify the property owners. The
consensus of the Commission is for staff to ask the applicant if they would agree to do
another notification to property owners.
Commissioner Fagelman moved to continue the hearing to August 5, 2002.
Commissioner Powers seconded the motion and it passed with Commissioners
Ostley, Powers, Tierney, Stadnik and Fagelman all voting yes.
IV. ADJOURNMENT
There being no other business before the Commission, Chair Ostly adjourned the
meeting at 7:22 p.m.
