ISSUE BEFORE COUNCIL
On November 14, 2019 Palisades resident Scott Handley submitted a Prospective Petition for an
Initiative Measure (20201N-1) to amend the Lake Oswego Charter.

BACKGROUND
On December 12, 2019, Mr. Handley was advised that Prospective Petition for an initiative
measure (20201N-1) to amend the Lake Oswego Charter was approved for circulation and had
two years to gather the required 4,365 signatures.
On June 9 and June 21, 2021, Chief Petitioners Scott and Joey Handley submitted signatures
totaling 4,696 - of which, 4,433 were verified as valid signatures.
On June 23, 2021, Mr. Handley was informed that he had met and exceeded the number of
required signatures for the Petition to be eligible for the November 2, 2021 ballot.
Oregon State law requires that the Elections Officer file the Measure with the City Council at
the next meeting after the petition has qualified for the ballot, which is Tuesday, July 6, 2021.
Included in this report is Resolution 21-23, confirming your receipt of the Measure.
DISCUSSION
The Council has 30 days after filing the Measure to review the Measure and pursue one of three
options before them to determine the next course of action:
1. The City can adopt the initiative.
2. The City can refer the initiative.
3. The City can refer the initiative and refer a competing measure.
A Special Council Meeting is scheduled for Tuesday, August 3, 2021 to consider the three
options. The Council must decide before August 5, 2021 (30 days from filing the Petition),
which is why a special meeting is scheduled for August 3, 2021.
RECOMMENDATION
Staff recommends adopting Resolution 21-23, receiving and filing Initiative Measure 20201N-1.

RESOLUTION 21-23
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE OSWEGO RECEIVING AND FILING
INITIATIVE MEASURE 2020IN-1 TO AMEND CHAPTER X OF THE LAKE OSWEGO CHARTER TO
ENHANCE PROTECTION OF THE CITY'S NATURAL AREAS.
WHEREAS, On November 14, 2019 Palisades resident Scott Handley submitted a Prospective
Petition for an Initiative Measure 2020IN-1 (Measure) to amend the Lake Oswego Charter; and
WHEREAS, On June 21, 2021 Clackamas County elections officials verified that Chief Petitioners
Scott Handley and Joey Handley met and exceeded the number of required valid signatures to
qualify the Measure for the ballot on the November 2021 election; and
WHEREAS, Oregon State Law requires the elections official file the Measure with the City Council
at the next meeting after the petition has qualified for the ballot (see ORS 250.325 and 254.095);
and
WHEREAS, the City Council has 30 days after filing the Measure to review the Measure and take
one of three actions:
1. Adopt the Measure.
2. Refer the Measure to the November election.
3. Refer the Measure and refer a competing measure.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Oswego that:
Section 1. Pursuant to ORS 250.325 and 254.095 the Council hereby receives and files
Initiative Measure 20201N-1.
Section 2. The Council shall review Initiative Measure 20201N-1 during an August 3, 2021
Special Meeting.
Section 3. Effective Date. This Resolution shall take effect upon passage.
Considered and enacted at the regular meeting of the City Council of the City of Lake Oswego on
the 6th day of July, 2021.
