NOTICE OF PUBLIC HEARING
DEVELOPMENT REVIEW COMMISSION
Date of Notice: June 1, 2023
TESTIMONY ON THIS LAND USE HEARING CAN BE
PROVIDED IN PERSON AT CITY HALL, REMOTELY VIA
ZOOM OR PHONE, AND BY SUBMISSION OF WRITTEN
TESTIMONY. PLEASE READ THIS NOTICE CAREFULLY
FOR DETAILS AND INSTRUCTIONS.
On Wednesday, June 21, 2023 at 7:00 p.m., the City of
Lake Oswego Development Review Commission (DRC)
will hold a public hearing in the Council Chambers at
City Hall, 380 "A" Avenue, Lake Oswego, Oregon to
consider the following development application.
File No.: LU 22-0059
Property Owner/Applicant: Habitat for Humanity
Portland Region
Applicant’s Representative: Ken Sandblast, Westlake
Consultants, Inc.
Location of Properties: 16858 Boones Ferry Road and
5100, 5054, and 5022 Upper Drive (Tax Reference:
21E18AB00400, -100, -200, and -300)
Nature of Application: The applicant is requesting
approval of:
• A Development Review Permit to construct 23
townhouses;
• A minor variance to reduce the required rear yard
setback from 25 to 20 feet for units D16-D23;
• Modification of LU 18-0024 (previously approved
23-lot subdivision for this site) to decrease the
mitigation tree planting size and shrub size;
• A major variance to reduce minimum landscape
planting sizes from 2 gallon to 1 gallon for shrubs
and from 3-inch caliper to 1.5-inch caliper for trees;
and,
• Removal of five (5) trees for development purposes.
Approval Criteria: Please see attached list.
Conduct of the Hearing: The Chair will open the public
hearing and describe the hearing procedure, and staff
will present its report. The Chair will then open the
hearing for public testimony. Testimony begins with the
applicant, followed by persons in favor of the
application, persons opposed, persons who are neutral,
and concludes with rebuttal by the applicant. Before
closing the hearing, the Chair will ask whether any
person who testified desires a continuance to submit
new evidence or testimony. If no continuance is
requested, the Chair will ask whether any party desires
the record to be left open for at least seven days for
submittal of additional evidence. Unless a continuance
is granted or the record is left open, the Chair will close
public testimony for deliberations and decision.
How To Testify: All interested persons are encouraged
to submit written testimony before the hearing or to
appear and testify orally either in person at City Hall or
remotely via Zoom or phone. See attached instructions
for testifying remotely. As a general rule, the applicant
will have 20 minutes to testify, groups (such as
neighborhood associations) will each have 10 minutes,
individuals will each have 5 minutes, and the applicant
will be given 5 minutes for rebuttal. The DRC may
modify these time limits, however, depending on the
circumstances. In order to be considered and become
part of the record, written comments must be received
by 12:00 noon on June 21, 2023. Submit written

NOTE: Failure to raise an issue at the hearing (either in
person, remotely via Zoom or phone, or by letter),
accompanied by statements or evidence sufficient to
afford the DRC an opportunity to respond to the issue
precludes appeal to the City Council and the Oregon
Land Use Board of Appeals (LUBA) based on that issue.

IMPORTANT: If you are not able to testify remotely for any reason, e.g., inadequate or faulty
internet connectivity, computer or phone equipment, or operation thereof by yourself, City
personnel, internet service providers, virtual meeting platform software, or other third parties
involved in transmission and receipt of your oral testimony, you are deemed to have waived your
oral testimony. You are strongly urged to also submit your testimony in writing to assure

OPTIONS AND REQUIREMENTS FOR PROVIDING TESTIMONY REMOTELY:
Providing Public Testimony Using the Zoom Online Option
• In order to receive the Zoom meeting link to allow you to testify online, you must register
online here by 12:00 noon on June 21, 2023. You must timely log in to the Zoom meeting
and testify when called upon during the hearing. If you have not registered you will not be
able to testify.
• You will need an internet connection and a computer. Your computer must have a
microphone in order to provide testimony and a camera if you wish your person to be
visible (not required).
• If you have presentation materials like photos, a video, or a PowerPoint presentation, a
copy must be submitted in advance per the written testimony instructions below.
Providing Public Testimony Using the Zoom Phone-in Option
• In order to receive the Zoom phone number to allow you to testify remotely by phone, you
must register here by 12:00 noon on June 21, 2023. You must timely call the Zoom number
and testify when called upon during the hearing.
• You will need a telephone or cellular phone
• You will be able to hear the meeting participants and may provide oral testimony when
called upon.
Written Testimony and Presentations
• Written testimony is due by 12:00 noon on June 21, 2023. Written testimony cannot be
submitted remotely during the hearing.
• Please see the Notice of Public Hearing cover page for how to submit written testimony or
presentations by e-mail or mail.
• Presentation Materials: In order for your presentation to be part of the record, you must
submit a copy to the City by 12:00 noon on June 21, 2023. You will be responsible for
“sharing” and controlling your presentation during your testimony; staff is not able to
display or control the presentation for you.
Livestreaming the Meeting or Watching on Tualatin Valley Community Television (TVCTV)
• Development Review Commission meetings are streamed live on the City's YouTube
channel, which can be accessed from the following link:
http://www.ci.oswego.or.us/boc/streaming-media. Livestreaming is a service provided by
the City and is not a requirement for public hearings.
• The meetings are also broadcast on TVCTV; check their website at http://tvctv.org/ for
details.
• Livestreaming allows you to view and listen only; you will not be able to participate in the
hearing. See above for how to participate in the hearing by computer, phone, or written
testimony.
• If participating by phone, you must mute your computer or TV; otherwise, your multiple
devices can create feedback and be a distraction for other participants. If the problem
persists you may be asked to leave the phone call.
