FINDINGS: This department has reviewed the above application for a property line
adjustment involving the properties described as T2S, R1 E, Section 7CA W.M., Tax
Lots 2901 and 2902. Pursuant to Section 1107 of the Clackamas County Zoning and
Development Ordinance, property lines may be adjusted between two (2) legal lots
within an urban or rural zoning district when the adjustment is consistent with all

remaining provisions of this ordinance. Therefore, the property line adjustment as
submitted is approved subject to the following conditions:
1. If one or both of the subject properties is located within an existing
subdivision or partition plat: The County Surveyor may require a partition plat (or
re-plat) to finalize the proposed property line adjustment. Please contact the
surveyor's office at (503) 353-4475.
2. For properties that are 10 acres or less in size: A Survey of Record or Partition
Plat and new legal descriptions shall be completed by an Oregon licensed surveyor.
The applicant shall prepare a standard notarized deed that will create the new lot
configurations by attaching the new legal descriptions written by their surveyor. The
Survey of Record, new deed and legal description exhibits shall be submitted to the
County Surveyor's Office within one (1) year of this approval together with all
applicable fees. (See attachment, Next Step, 3.(a).)
3. All new and existing structures located on the property shall satisfy the setback
requirements of the R-10 zoning district, Section 301 of the Zoning and
Development Ordinance (ZDO).
4. Property within the R-10 zoning district that exceeds 10,000 square feet in area
shall not be allowed to adjust below the 10,000 square foot minimum lot size of the
district.
5. For properties that are 10 acres or less in size: Prior to Planning approval of the
final Survey of Record or Partition Plat, the applicant's Oregon licensed surveyor
shall provide a stamped drawing to the Planning department file showing the
setbacks for existing structures in relation to the newly created property lines. If no
structures exist on the subject properties, a stamped letter from the applicant's
surveyor indicating such shall be provided in lieu of the drawing.
6. If one or both of the subject properties are connected to, or will be connected
to, and served by a subsurface sewage disposal system (septic tank and
drainfield), each applicant is responsible for ensuring that every existing and
proposed subsurface sewage disposal system for the subject properties will not be
adversely affected in any way by this proposal. Please contact the Soils Department
at (503) 353-4740.
7. If the access for one or both of the subject properties is proposed to be a new,
re-located, re-configured, or in some way added or changed access, each
applicant is responsible for ensuring that the new, re-located, re-configured, or in
some way added or changed access is feasible per County access standards prior
to Survey of Record sign-off. Please contact the County Engineering Division at
(503) 353-4681.

8. The new parcels must conform to the approved site plan submitted to and approved
by the Planning Division.
9. Approval is subject to the above stated conditions. Failure to file a Survey of
Record, (if required) or Partition Plat (if required) and at minimum the new legal
instruments (new deeds) to the County Surveyor's Office within one (1) year will
cause this approval to automatically become void.
10. The property owner shall contact the Clackamas County Assessor's Office according
to ORS 308.210(4) insuring that all taxes certified for collection are paid in full prior
to recording of the new deeds for the property line adjustment. (Note: Failure to pay
all taxes certified for collection will stop the processing of a property line adjustment until
paid.)
11. The approval of the application granted by this decision concerns only the applicable
criteria for this decision. The decision does not include any conclusions by the
County concerning whether the activities allowed will or will not come in conflict with
the provisions of the federal Endangered Species Act (ESA). This decision should
not be construed to or represented to authorize any activity that will conflict with or
violate the ESA. It is the applicant, in coordination if necessary with the federal
agencies responsible for the administration and enforcement of the ESA, who must
ensure that the approved activities are designed, constructed, operated and
maintained in a manner that complies with the ESA.

Evaluation of soil conditions for on-site sewage disposal.
On 02-06-2007 five (5) test pits were excavated to review the soil conditions at the
property described above for the purpose determining if the soil condition meets the State
of Oregon Department of Environmental Quality rules for on site sewage disposal. The
soil conditions in all test pits meet the DEQ rules for on-site sewage disposal. 'The soil.
conditions are suitable for standard drain field construction; however limitation on
available area is likely to require pre-treatment by a sand filter system or an alternative
treatment system.

Oregon. (T2S, R1E Section 7CA, Tax lot 2901).Pacific Habitat Services, Inc. (PHS) conducted
an on-site wetland determination on April 12, 2007.
This approximately 1.25 acre site is bordered to the west by Kimball Street, with large residential
lots located to the east and south. The parcel to the north is forested and undeveloped. The site is
nearly flat but local topography slopes generally to the east. The single residence on the site is
located in the western portion. Though forested throughout, the eastern portion is the backyard of
the residence and is generally landscaped or maintained as lawn. Common trees include Oregon
white oak(Quercus garryana), Douglas fir(Pseudotsuga menziesii), and western hemlock
(Tsuga heterophylla). Landscape trees and shrubs include heather, laurel, rhododendrons, and
azaleas. The lawn is composed of mixed grasses species and weedy forbs. English ivy is common
in unmaintained or unmowed areas.
On-site soils are mapped as Salem silt loam, which is not a hydric soil. Though documented soils
were less gray then the typical Salem soil, there is no evidence of recent disturbance of soils, and
no hydric soil indicators were identified on the site. The soils were dark brown (IOYR 2/2)and
were well drained and predominantly silt loam in texture. As a result these soils are not
indicative of hydric conditions. There were also no indicators of wetland hydrology, and no
drainage features or wetland areas were identified on the site.
Though the National Wetlands Inventory(NWI)map of the site does not identify the presence of
any wetlands in the vicinity of the site, the City of Lake Oswego Local Wetlands Inventory
(LWI) map does. Wetland W-15 is mapped across parcels to the east, with its southwestern
boundary extending across the northeast corner of Lot 2901, onto the parcel to the north.
Sample site 1 (included with this letter) verifies that the wetland does not extend onto Lot 2901.
An off-site assessment of conditions on properties bordering the site indicate that the nearest

wetland is located approximately 30 feet north of the site, with a larger wetland located about 75
feet to the
northeast. The actual extent of each wetland was not assessed, only the extent of
wetland closest to the site. It is possible that these two wetland areas are part of one larger
wetland, though they do appear to be separate features. The off-site wetlands are dominated by
Oregon ash, with
8an understory that includes nootka rose (Rosa nutkana)
na) and slough sedge
(Carex obnupta). Wetlands and uplands in this area have a high percent cover by English ivy
This assessment of off-site conditions is consistent with previous work performed by PHS. That
work included a wetland determination on Lots 200 and 300, due east of Lot 2901. That
assessment verified the presence of wetland within the central and eastern portions of lot 200..
Our investigation found no water quality resource areas, as defined by Water Environment
Services regulations, on the site. Two wetlands were identified on adjacent parcels. The smaller
wetland(likely less than one-half acre) is located to the north and is located approximately 30
feet from the northern property boundary. A larger wetland (likely greater than one-half acre in
size)was identified a distance of about 75 feet from the site. Based upon the gentle slopes
between the site and the wetlands, the regulated vegetated corridor adjacent to each wetland
would be 50 feet wide. Assuming the westernmost wetland is approximately 30 feet from the
site, the regulated vegetated corridor would extend approximately 20 feet onto the site. The
buffer associated with the eastern wetland would not reach the site.
The boundaries of wetlands on adjacent parcels were determined as accurately as possible but a
formal delineation may be necessary if greater accuracy is required. Documentation of our on-site
determination and photographs of the site and off-site areas are included with this letter.
