A request from the City of Lake Oswego for amendments to the Community Development Code to change the criteria for designating and removing a Resource Conservation (RC) District. In conjunction with the code amendment, the City is proposing amendments to the Comprehensive Plan Map and Zoning Map to remove the existing RC District from 37 properties.
The purpose of the proposed code amendment is to allow for the removal of the RC District from isolated tree groves on private property (not including private designated open space tracts). “Isolated tree groves” are tree groves that are not connected to stream corridors or wetlands. The code amendment would also change the criteria for applying the RC District, so that an RC District is not applied to isolated tree groves on private property in the future. The amendments to the Comprehensive Plan Map and Zoning Map would remove the existing RC District from isolated tree groves located on 37 private properties.
The City Council approved similar code changes and removed the existing RC District from 45 properties in July 2012 (file LU 12-0012). Metro appealed that decision to the Land Use Board of Appeals (LUBA), and LUBA found that removing the RC District from eight of the properties did not comply with Metro Title 13. LUBA remanded the decision, which reversed all of the code changes and map amendments. The City of Lake Oswego is proposing to make the code changes and map amendments again, in a manner that complies with Title 13.
The proposed Code amendments apply citywide. The proposed Comprehensive Plan Map and Zoning Map amendments apply to the following properties:
