LU 15-0017: CDC Amendments - Substandard Lots
A request by the City of Lake Oswego for legislative amendments to the Community Development Code (Chapter 50) for the purpose of amending LOC sections 50.10.003.2, 50.01.006.5 and 50.04.003.2.b regarding how substandard lots (lots that do not meet the minimum lot size or other Code standards) are treated for development and lot line adjustment purposes.
Explanation of Proposal:
An amendment to the definition of “Lot” to clarify when development may occur on substandard lots. Amendments to other sections of the Community Development Code will add criteria for how development can occur on substandard lots and requirements regarding lot line adjustments involving substandard lots.
Amendments are proposed to the following code sections: LOC 50.01.006.5 Non-Conforming Lots; LOC 50.03.002 Residential Use Table; LOC 50.04.003.2.b General Exception to Lot Area and Dimension Requirements, Lot Line Adjustments; LOC 50.07.003 Review and Approval Procedures, and LOC 50.10.003 Definitions.

On November 3, 2015, the City Council opened the hearing and immediately continued it to December 1, 2015.

At its meeting July 27, 2015, the Planning Commission approved the Findings, Conclusions and Order (the final recommendation).
The City Council study session is scheduled for September 15, 2015. The public hearing is tentatively scheduled for October 20, 2015.

At its meeting on Monday, July 14, the Planning Commission re-opened the public hearing to two specific issues (see 06/23/15 update below), accepted public testimony, held deliberations and made a preliminary recommendation. The Findings, Conclusions and Order (the final recommendation) will be considered on July 27, 2015.

At its meeting on Monday, June 22, the Planning Commission continued deliberation during review of the draft Findings, Conclusions and Order. The Commission postponed further consideration of the Findings and moved to re-open the hearing for public testimony on July 13, regarding the following two issues only:
- Whether there should be height limitations on substandard lots beyond the zone height limitations, e.g., determination of maximum building height similar to flag lots; and
- Whether there should be minimum lot area requirements for lot line adjustments involving a substandard lot or whether a minimum “developable lot” area should apply to all substandard lots.

At its meeting on Monday, May 11, the Planning Commission deliberated and made a preliminary decision to recommend that the City Council approve the proposed changes as amended during deliberations. Staff was instructed to return on June 22, with revised draft code and Findings, Conclusions and Order for Planning Commission consideration.

At its meeting on Monday, April 27, the Planning Commission opened the public hearing and accepted testimony. The public testimony portion of the hearing (oral and written) was closed and the hearing was continued to May 11, for deliberations.
