LU 20-0019: Community Development Code Amendments Related to Seasonal Outdoor Dining Enclosures
A request from the City of Lake Oswego for amendments to Chapter 50 (Community Development Code) for the purpose of allowing seasonal restaurant enclosures (Nov. 1 – April 30) on private property in commercial zones.
Proposed amendments are to the following Lake Oswego Code sections: 50.03.003.6 Use Specific Standards for Commercial Uses; 50.06.001.5 Commercial Building Design standards; 50.07.003.13 Ministerial Development Decisions; and 50.10.003 Definitions. Depending on location, size and height of the restaurant enclosures, the review process will either be a Ministerial or Minor Development decision (see attached draft code amendments for more details). The Commercial Building Design standards listed in 50.06.001.5 for seasonal enclosures would apply subject to minor development review process (50.07.003.14). The following Overlays and Design Districts would not apply to seasonal restaurant enclosures: 50.05.004 Downtown Redevelopment Design District; 50.05.005 West Lake Grove Design District; 50.05.007 Lake Grove Village Center Overlay District; and 50.05.008 Southwest Overlay District.

At its meeting on Monday, August 10th, the Planning Commission adopted the Findings, Conclusions and Order (final recommendation). A link to the adopted Findings is available in the Public Records file.

On July 27, the Planning Commission held a public hearing and made a preliminary recommendation that the City Council approve the proposed amendments. The Commission is scheduled to consider adoption of the Findings, Conclusions and Order (final recommendation) at its meeting on August 10th.

On Monday, July 27, 2020, the Planning Commission will hold a public hearing to consider the proposed amendments.
The public hearing notice is available in the "Public Records" file. The staff report will also be available in the "Public Records" file ten days prior to the hearing.
