PLANNING & BUILDING SERVICES HIGHLIGHTS FOR JULY, 2020

CITY COUNCIL (CC) ACTIONS ON PLANNING ITEMS

On July 7 the CC:

  • Conducted a public hearing and tentatively approved Ordinance 2841, An Ordinance of the City of Lake Oswego Amending various municipal code provisions relating to historic preservation (LU 19-0008).
  • Tentatively approved Ordinance 2849, An Ordinance Annexing to the City of Lake Oswego Two Parcels Consisting of 0.42 Acres at 19230 Red Wing Court; Declaring City of Lake Oswego Zoning (AN 20-0004).

On July 21 the CC:

  • Enacted Ordinance 2849, and adopted Findings, Conclusions and Order for, An Ordinance Annexing to the City of Lake Oswego Two Parcels Consisting of 0.42 Acres at 19230 Red Wing Court; Declaring City of Lake Oswego Zoning (AN 20-0004).
  • Received an update on the State’s rule making process for House Bill 2001 and approved a grant agreement with the Oregon Department of Land Conservation and Development for House Bill 2001 planning services (PP 19-0008).

PLANNING COMMISSION (PC) ACTIONS

On July 13, the PC conducted Work Session #1 on the 2020 Annual Community Development Code Amendments (LU 20-0015).

On July 27, the PC:

  • Conducted a public hearing and tentatively recommended approval of Community Development Code amendments allowing Seasonal Outdoor Dining Enclosures (LU 20-0019).
  • Received an update on the State’s rule making process for House Bill 2001 and House Bill 2003 (PP 19-0008).
  • Conducted a work session on the Sustainability and Climate Action Plan recommendation regarding Electric Vehicle Charging Stations (PP 19-0004).

DEVELOPMENT REVIEW COMMISSION (DRC) ACTIONS

On July 6, 2020, the DRC:

  • Continued the public hearing on LU 19-0041, a request for approval of a lot line adjustment, RP District delineations, a Development Review Permit to construct a 160-unit multi-family housing project, approval of a parking study for shared parking, an unavoidable utility crossing for stormwater, minor variances to retaining wall standards, and the removal of 112 trees. The site is located at 5600 Meadows Road.
  • Held a public hearing on LU 19-0044, a request for a 10-lot subdivision with a planned development overlay; and, the removal of 152 trees for construction of site improvements. The site is located on Waluga Drive.

On July 20, 2020, the DRC:

  • Approved the Findings, Conclusions and Order 5:2 for LU 19-0041, a request for approval of a lot line adjustment, RP District delineations, a Development Review Permit to construct a 160-unit multi-family housing project, approval of a parking study for shared parking, an unavoidable utility crossing for stormwater, minor variances to retaining wall standards, and the removal of 112 trees.   • Approved the Findings, Conclusion and Order 7:0 for LU 19-0044, a request for a 10-lot subdivision with a planned development overlay; and, the removal of 152 trees for construction of site improvements. The site is located on Waluga Drive.
  • Held a work session for Recommendation to the City Council for a traffic study in Lake Grove and the Kruse/Meadows/Carman Drive area in light of recently approved projects.

HISTORIC RESOURCES ADVISORY BOARD (HRAB)

The Historic Resources Advisory Board held their July meeting and discussed the following:

    1. National Register Program Update – Comments due August 14, 2020 at 5:00 pm
    2. Historic Preservation Grant
    3. Preservation Month
      Merit Award – Youth Villages Oregon
      House Plaque – Nancy Tongue
    4. Development of a Preservation Handbook

July was National Preservation Month. Every year during the month of July, communities throughout the nation celebrate Preservation Month, first created in 1971 by the National Trust for Historic Preservation. Over the past several years, Lake Owego has celebrated Preservation Month by presenting a Preservation Merit Award to an individual or group who has excelled in the field of preservation and a bronze plaque is presented to a homeowner whose property is on the Landmark Designation List. Workshops and tours are conducted by the Lake Oswego Preservation Society and the Oswego Preservation Council. Unfortunately, Lake Oswego’s Preservation Month 2020 will be postponed due to the ongoing COVID-19 pandemic. Many of the events originally scheduled for this year have been rescheduled for July, 2020.

ADMINISTRATIVE LAND USE DECISIONS

Staff approved two administrative land use cases:

  • LU 20-0007, a request for a RID Variance to construct an addition to an existing single-family dwelling at 16720 Alder Circle. The Notice of Decision was issued on July 15, 2020.
  • LU 20-0018, a request for a RP District delineation at 13561 Goodall Road. The Notice of Decision was issued on July 23, 2020

PRE-APPLICATION CONFERENCES

In July, staff held nine pre-application conferences as follows:

  1. PA 20-0039, New detached accessory dwelling unit on Bonaire Avenue.
  2. PA 20-0040, Modification to an approved Development Permit to modify siding required as a condition of approval on Rosewood Street.
  3. PA 20-0041, Modification to an approved Development Permit for additions to Hallinan Elementary School on Hawthorne Drive.
  4. PA 20-0042, New detached ADU on Blue Heron Road.
  5. PA 20-0043, Similar use determination for certain businesses in the Kruse Village Shopping Center to be classified as Specialty Food instead of Restaurant on Meadows Road.
  6. PA 20-0044, Lot line adjustment on Blue Heron Road and Westview Drive.
  7. PA 20-0046, 3-parcel minor partition with 2 flag lots on Washington Court.
  8. PA 20-0047, 2-parcel minor partition and Resource Protection (RP) District delineation on Inverurie Road.
  9. PA 20-0048, Parking study on 3rd Street.

PLANNING REVIEW OF BUILDING PERMITS, SIGN PERMITS AND BUSINESS LICENSES

In the month of July, Planning staff reviewed 22 building permits, 4 sign permits and 18 business licenses.

CODE ENFORCEMENT

In July, 5 code enforcement cases were resolved without Municipal Court action.

PERMIT CENTER ACTIVITY

Customer Contacts:  During the month of July, the Permit Center was open by appointment only and closed to walk-in customers. Staff responded to 855 phone calls, or approximately 39 customer contacts per day. Of the phone-in customers 38% were for Planning, 35% for Building, 7% for Engineering and 20% for other services.

Building Permit Activity: During July, Building staff issued three demolition permits on Crest Drive, Bayberry Road and 6th Street. Five New Single Family Residential (NSFR) applications were received. Nine NSFR permits were issued as follows:

  1. Wildwood Street
  2. Summit Drive
  3. Upper Drive
  4. Goodall Road
  5. Graef Road
  6. Waluga Road
  7. Stafford Road
  8. Mapleleaf Court
  9. Bonaire Avenue

The above median timeline for review is from application completeness to “ready to issue”. As of November 2018, the Planning Department has provided NSFR plan review services for both Planning and Engineering reviews. Ready to issue includes time that applicants need to address corrections required for code compliance or factors beyond the City’s control.

In addition to NSFR permits, Residential Structural Permits include remodels, additions, decks, etc., of which there were 24 issued in July by Building staff, with the median days being 39. Commercial Structural Permits include Commercial, Industrial, Multi-Family and Institutional, of which there were 20, with the median days being 8.
