CITY COUNCIL (CC) ACTIONS ON PLANNING ITEMS
At their regular meeting on September 1, the CC:
- Conducted a public hearing on a Measure 49 Claim for 1870 Twin Points Road. The CC tentatively approved waiving a land use regulation and not providing compensation to the owner.
- Conducted a public hearing on Community Development Code amendments allowing Seasonal Outdoor Dining Enclosures. (LU 20-0019) The CC adopted findings and enacted Ordinance 2851 for LU 20-00019 on September 15, 2020.
- Conducted a public hearing and enacted Ordinance 2828 amending Chapter 42 of the Lake Oswego Code to add regulations for the use of the Public Pedestrian Walkway portion of Block 137.
- Approved Ordinance 2841 amending code sections related to the Historic Resources Advisory Board and sections of the Lake Oswego Community Development Code relating to Historic Resource Development Permit Procedures, Criteria and Related Provisions and added a new section to address “Demolition by Neglect”.
On September 15, the CC approved Resolution 20-29, finalizing its decision on a Measure 49 Claim for 1870 Twin Points Road, deciding to waive a Community Development Code standard for the subject property.
PLANNING COMMISSION (PC) ACTIONS
On September 14, 2020, the PC received an update on House Bills 2001 and 2003.
On September 28, 2020, the PC conducted a public hearing on the 2020 Annual Community Development Code Amendments and tentatively approved the amendments. (LU 20-0015)

DEVELOPMENT REVIEW COMMISSION (DRC) ACTIONS
On September 9, 2020, the DRC held a public hearing for LU 19-0049, a request for Development Review Permit for a structure accessory to an existing car wash located in the Lake Grove Village Center Overlay. The DRC continued the hearing to November 16, 2020, to allow the applicant to submit revised plans.
On September 21, 2020, the DRC held a public hearing for AP 20-03 [TR 499-20-02350], a request for Type II permit to remove seven trees for landscaping purposes. The DRC approved the application 6:0 and scheduled the adoption of the findings on October 5, 2020.
HISTORIC RESOURCES ADVISORY BOARD (HRAB)
At their meeting of September 9, 2020, HRAB discussed the following:
- The Preservation Handbook, the handbook will supplement the recently adopted Historic Preservation Code
- Conduct a Reconnaissance Level Survey of Lake Grove. This survey will document the remaining structures over 50 years old of historic significance in Lake Grove.
- Friends of Luscher Farm: HRAB began coordinating and discussing future uses of the Barn at Luscher Farm.
- 4101 South Shore (Bates House) HRAB members would like the city to work with the property owner and develop a plan for the stabilization of the existing dwelling.
ADMINISTRATIVE LAND USE DECISIONS
Staff approved four administrative land use cases as follows:
- LU 20-0008, a request for 2-parcel partition on a lot containing a historic landmark and a Resource Preservation (RP) District delineation on Cherry Lane. The Notice of Decision was issued on 09/14/2020.
- LU 20-0022, a request for modification to an approved Development Permit to modify a condition of approval requiring horizontal siding on a commercial building to allow vertical siding on Rosewood Street. The Notice of Decision was issued on 09/10/2020.
- LU 20-0023, a request for a lot line adjustment on Westview Drive. The Notice of Decision was issued on 09/03/2020.
- LU 20-0024, a request for a Development Permit Modification of LU 19-0051 to revise the previously approved “maker space” addition on the Hallinan Elementary School on Hawthorn Drive. The Notice of Decision was issued on 09/18/20202.
PRE-APPLICATION CONFERENCES
In September, staff held seven pre-application conferences as follows:
- PA 20-0055, Development Review Permit, with possible design variances, to construct a detached carport for an existing office building in the Lake Grove Village Center Overlay on Boones Ferry Road.
- PA 20-0056, 2-parcel minor partition on Glenmorrie Drive.
- PA 20-0057, RP Delineation and construction of a new single-family dwelling on a lot that is most encumbered by an RP District on Glenwood Court.
- PA 20-0058, One-lot partition to legalize an illegally created lot on Atherton Drive.
- PA 20-0059, 2-parcel minor partition with a flag lot on Twin Points Road.
- PA 20-0060, RID variances to construct additions to an existing single-family dwelling on North Shore Road.
- PA 20-0061, RID variance for additions to an existing single-family dwelling on Olson Ave.
PLANNING REVIEW OF BUILDING PERMITS, SIGN PERMITS AND BUSINESS LICENSES
In the month of September, Planning staff reviewed 26 building permits, 8 sign permits and 22 business licenses.
CODE ENFORCEMENT
In September, 10 Code Enforcement cases were resolved without Municipal Court action.
PERMIT CENTER ACTIVITY
Customer Contacts: During the month of September, 2020, the Permit Center was open by appointment only and closed to walk-in customers. Staff responded to 1,470 phone calls, or approximately 67 customer contacts per day. Of the phone-in customers 26% were for Planning, 38% for Building, 7% for Engineering and 29% for other services. Staff served walk in-customers via the vestibule, mailed information, posted public information, posted signs for trees and public hearings and regular remote meetings to ensure social distancing.
Building Permit Activity: During September, Building staff did not issue any demolition permits. One New Single Family Residential (NSFR) application was received. Seven NSFR permits were issued as follows:
- Atwater Road
- Upper Drive
- Upper Drive
- Amber Place
- Lake Garden Court
- Goodall Road
- Palisades Crest
The City converted to new State of Oregon E-permitting software in August, which resulted in some delays in processing permits.
The above median timeline for review is from application completeness to “ready to issue”. As of November 2018, the Planning Department has provided NSFR plan review services for both Planning and Engineering reviews. Ready to issue includes time that applicants need to address corrections required for code compliance or factors beyond the City’s control.
In addition to NSFR permits, Residential Structural Permits include remodels, additions, decks, etc., of which there were 13 issued in September by Building staff, with the median days being 49. Commercial Structural Permits include Commercial, Industrial, Multi-Family and Institutional, of which there were25 permits issued, with the median days being 8.
In addition, the Building Department issued one new commercial structural permit for a library and office on County Club Road.
