What is Ordinance ZDO-286?

At the request of the City of Lake Oswego, Clackamas County has proposed amendments to their Comprehensive Plan and Zoning and Development Ordinance (ZDO) that would create a procedural framework for the County to consider applications from local jurisdictions to develop public park uses on agricultural lands. ZDO-286 proposes to establish an overlay zone, the Special Use Overlay District (SUOD), which would be applied at the time of County approval of a local park master plan and create a pathway for properties to be developed with public park uses that are not otherwise permitted in base zones such as the Exclusive Farm Use (EFU) district.

What does Ordinance ZDO-286 mean for Luscher Farm?

Luscher Farm and the surrounding Luscher area properties are located in Clackamas County and zoned EFU. Under the County’s current zoning rules, many of the uses proposed in the Luscher Area Master Plan—such as community garden expansion, accessible public parking, trails, trailhead facilities, picnic shelters, and play areas—are not permitted. Ordinance ZDO-286 would create a pathway for the City of Lake Oswego to apply to the County to develop the uses described in the Luscher Area Master Plan and implement the community’s vision for public use of the Luscher area. Without adopting these amendments, the City may be required to scale back the community’s use of Luscher Farm to comply with County regulations.

When and where will adoption of ZDO-286 be considered?

The first hearing with the Clackamas County Planning Commission took place on Monday, September 11. The Clackamas County Board of County Commissioners will also hold a hearing to consider the Planning Commission’s recommendation and receive testimony from the public on the proposed County amendments (ZDO-286).

Written testimony submitted by 4 p.m. on Monday, September 18 will be included in the meeting packet send to the Commissioners in advance. All written testimony is due by 4 p.m. on Tuesday, September 26 for the Board of County Commissioners hearing.
