Changes to Type II Tree Removal Permits for Eligible Residential Projects

Beginning July 1, 2026, a new Oregon law (House Bill 4037) changes how the City processes eligible Type II tree removal permits, specifically those associated with residential development for new homes or replacement homes on the Clear & Objective review track (no variances requested that require discretionary review). This new process does not apply to Type II tree removal requested for other purposes.

The law requires cities to use a faster and more limited public notice and appeal process for eligible tree removal permits. Until the City completes updates to its Tree Code, we are following the State-required process to maintain compliance with State law.

What's Changing?
For eligible Type II tree removal permit applications, the City will now:

• No longer require a yellow Type II Tree Removal sign to be posted on the property.
• Continue to require yellow ribbons to mark the tree(s) proposed for removal.
• No longer post these applications on the City's "Pending Type II Permits" webpage.
• Mail notice of the 14-day public comment period only to property owners within 100 feet of the property.
• Limit appeals of the City's tentative decision to the applicant only, as required by State law.

Why is This Changing?
These changes are required by Oregon House Bill 4037, which is intended to streamline the review of certain residential development applications. Because State law took effect before the City could complete updates to its Tree Code, the City must follow the State requirements until the local code amendments are adopted.

Tree Code Update
