LU 18-0035: Community Development Code Annual Amendments (2018)

Project Background / Summary: 

Code Maintenance amendments are those that correct or add cross-references, clarify existing standards, or update requirements based on changes to other codes (e.g., Tree Code, Building Code, etc.).  The maintenance items generally do not involve policy considerations and include the following:

  1. Compliance with Comprehensive Plan/DRD District [LOC 50.05.004.12.a]
  2. Uplands R-10 Overlay/Height and Impervious Surfaces Applicability [LOC 50.05.012.5-7]
  3. Street Connectivity/Access Lanes [LOC 50.06.003.4]
  4. Lighting Standard Waiver [LOC 50.06.004.3]
  5. Solar – Non-Exempt Trees [LOC 50.06.007, LOC 50.10.003 and Appendix 50.11.004-D, Section 5 (reference)]
  6. 100-day clock for Affordable Housing [LOC 50.07.003]
  7. Written Evidence Deadline [LOC 50.07.003.4.c.ii]
  8. Master Plant List Amendments [LOC 50.11.004 – Appendix D]

Policy Amendments (LOC Chapters 50.04, 50.05 and 50.06)

10/23/18

On Monday, October 23, the Planning Commission adopted the Findings, Conclusions and Order (final recommendation).  A link to the adopted Findings is available below under "Key Documents."

10/09/18

On Monday, October 8, 2018, the Commission held a public hearing on the proposed amendments, no public testimony was received at the hearing.  To meet noticing requirements, the hearing was continued to Monday, October 22nd; testimony will continue to be accepted until the hearing is closed.  After the public hearing and deliberations, the Commission may make a final recommendation and consider adoption of the Findings, Conclusion and Order.

08/30/18

The Planning Commission will hold a public hearing on proposed amendments to the Community Development Code on Monday, October 8, 2018. There are 14 proposed amendments which include the following :

  • Increase setbacks on lots zoned high-density (R-0, R-2 and R-3) when they abut lots that will be zoned low density (R-7.5, R-10 and R-15) upon annexation into the City
  • Update all references of “exempt” and “non-exempt” vegetation to “solar friendly” and “solar unfriendly” vegetation, respectively, to be consistent with the Solar Friendly Trees Report in LOC Appendix 50.11.004-D (5)
  • Delete the Solar Access Permit standard
  • Amend the applicability of the Solar Access standard to apply to subdivisions, but not to partitions or lot line adjustments
  • Identify appropriate exceptions to the utility undergrounding requirement

On Monday, July 23, 2018, the Commission will hold a work session to review and provide input on the Solar Code and issues identified by staff in its implementation.  Undergrounding of utilities will also be reviewed.
