PP 21-0004: Short-Term Rental Sunset Clause
The Planning Commission will conduct a public hearing to make a recommendation to the City Council on a proposed ordinance to amend Ord. 2815, Section 4, to either remove the “sunset clause” or to extend the repeal date to a later date. If the “sunset clause” is removed, the short-term rental lodging code amendments enacted by Ord. 2815 would continue; if the date of the “sunset clause” is extended, the repeal date would be extended to the new date.
Ordinance 2815 was adopted July 16, 2019, amending LOC Ch. 50 to authorize “short-term rental lodging” within residential zones, subject to certain standards stated in LOC 50.03.004.1.b.ii. The ordinance contained a “sunset clause” (Section 4) to repeal the authorization effective July 16, 2021.

On June 1, 2021, the Lake Oswego City Council made its final decision on Ordinance 2869, with Option 2, which removes the sunset clause provision. This repeals Ordinance 2815, Section 4 which shall be of no further force or effect. All other provisions of Ordinance 2815 (allowing short-term rental lodging use in certain zones) shall remain. Ordinance 2869 shall take effect on the 30th day of enactment, which is July 1, 2021.

At its meeting on Monday, April 26th, the Planning Commission recommended that City Council extend the sunset clause to July 16, 2022. The City Council public hearing is scheduled for Tuesday, June 1, 2021; a link to the notice is available in the Public Records File.
