PP 24-0004: Mandatory Adjustments Related to Housing Production - Senate Bill 1537

Senate Bill (SB) 1537 is a Housing Production Bill passed in 2024 as part of the state’s ongoing efforts to address Oregon’s housing crisis. The legislation introduces measures aimed at increasing housing production and affordability. Major components of the bill include the creation of a Housing Production Accountability Office to ensure compliance with state housing laws, provide technical support to local governments and developers, and minimize barriers to housing production; allowing applicants to opt in to new or amended housing laws that become effective during their application process; classifying certain housing development applications as limited land use decisions; and establishing a process to require cities to approve certain state-mandated housing land use adjustments if conditions and criteria are met.

01/07/2025 - Exemption Request

SB 1537 includes a process to require cities to approve certain state-mandated housing land use adjustments if conditions and criteria are met (Section 38). The city has submitted a request for an exemption from the mandatory adjustment process, with several code amendments necessary:

  1. The city submitted an exemption request to the HAPO on December 26, 2024. During review of the city’s application, the mandatory adjustment provisions of Senate Bill 1537 (2024 Session) do not apply until the HAPO issues a final decision, which must be issued within 120 days or by April 25, 2025. Interested parties may sign up to receive public notice for the city’s application on DLCD’s Housing GovDelivery, including a 45-day opportunity to submit public comments during the 120-day review period.
  2. The city will continue to apply the local Minor Development process per LOC 50.07.003.14 to review adjustment (variance) requests in lieu of the mandatory adjustment provisions of SB 1537.

08/26/2024 - Work Session

The Planning Commission will receive an update on Senate Bill (SB) 1537 implementation in Lake Oswego. When available, the Staff Report can be found in the Public Records Folder.


07/30/2024 - City Council Study Session

The City Council will receive an update on the implementation of Senate Bill (SB) 1537 in Lake Oswego and provide direction to staff on whether to apply for an exemption to Section 38, Housing Land Use Adjustments, of the bill.  When available, the Council Report can be found in the Public Records Folder.
